The Client is the account holder 
Ace Online is the Internet Service Provider

• The client engages Ace Online to provide a service enabling connection to the Internet
• The client will control and be responsible for any access by a minor to the network, either via the client's computer or access code. 
• The client is solely responsible for all use of their account, whether such usage is accidental or a result of deliberate or negligent action on their part. 
• The client declares they are over the age of 18 years or have obtained the authorisation of a parent or guardian. If the client is under the age of 18 years, such authorisation must be provided to Ace Online. 
• In the event of a system failure for whatever reason, Ace Online are not responsible for any damages or consequential losses incurred. 
• Ace Online shall provide a Free telephone support service to all local call, non mobile phone customers. Any calls extending beyond that service will be at the discretion of Ace Online. As this is a Free service, regrettably the service is not extended to return mobile phone calls. 
• The Internet Service provided by Ace Online is not to be used by the client or any associated individuals or group of persons, for any activities that are of an illegal or fraudulent nature, including but not limited to any activities prohibited under the Australian Commonwealth Government Telecommunications Act 1989, or under other applicable Australian State and Commonwealth laws; and/or any unauthorised use of copyright material. 
• The Client at their own risk, uses the software as provided by Ace Online. Ace Online will not accept responsibility for any damage to any software or hardware resulting from the use of the software. 
• It is the Client's responsibility to ascertain the full cost of accessing the Service, including but not limited to carrier charges imposed by any telephone company used to access the Service. Although Officers of Ace Online may provide advice regarding telephone carrier charges, it is the Client's responsibility to confirm this advice by contacting their carrier directly. 
• The Client uses the Internet at their risk. Ace Online does not warrant to monitor or control all the of the information and data accessed by the client. Neither Ace Online nor its employees, shall be held responsible in any way for anything accessed through the service. 
• Whilst Ace Online takes every care possible to ensure the security of their system, they accept no responsibility for loss of data. 
• Ace Online, at its own discretion, reserves the right to deny access to any potential Client. 

• The Client agrees to pay all such charges as are incurred through their usage of the Service. 
• Ace Online reserves the right to terminate any connection due to misuse or abuse. What constitutes misuse or abuse is determined by Ace Online. 
• The Client acknowledges that any non processing of their subscription funds, will incur a $20 fee, payable to Ace Online. This will include dishonoured cheques, refer to drawer notices and insufficient funds notices. Ace Online may choose to waive the penalty at their discretion. 
• The Client enters into an agreement with Ace Online, for the provision of an Internet connection for a certain period of time at a predetermined price. Within 14 days of the expiration of the period, Ace Online agrees to contact the Client with a renewal invoice, based on the same time duration as before and at the then prevailing rate. The client is to notify Ace Online should they require any variance to the contract period. This must be done before the renewal date. 
• The Client acknowledges that any failure to make payment before the due date, will entitle Ace Online to immediately terminate the Client's account. Any renewal shall render the Client liable to a $5 reconnection fee. 
• Ace Online reserves the right to vary the rate of and manner of charges at any time. Any changes will affect only renewals and not existing accounts already paid for. 
• It is the Client's responsibility to notify Ace Online before the due date, if the service is no longer required. 
• The Client acknowledges that their non use or minimal use of the service, does not constitute a right to a full or partial refund of fees.
